2011-12 Enacted New York State Budget Overview
New York State Higher Education Services Corporation (HESC)

The enacted 2011-12 New York State Budget provides for the following changes for HESC-administered programs:

• Reduces the maximum TAP award for students matriculated in certain, non-public two-year degree programs to $4,000.
• Continues the requirement that private pension and annuity income be included in the calculation of income for purposes of determining TAP eligibility.
• Continues to require that students in default on any State or federal student loan be ineligible for a State grant or loan.
• Continues the maximum TAP award reduction for independent students who have a spouse and no children at $3,025, consistent with awards provided to single adults with no children.
• Continues the elimination of TAP for graduate students.
• Eliminates the $75 across-the-board reduction to student TAP awards.
• Eliminates the two percent reduction to scholarship awards.
• Extends the statutory authorization for the Regents Physician Loan Forgiveness Program until 2015-16, and authorizes awards retroactively to 2009-10.
• Extends the statutory authorization for the New York State Licensed Social Worker Loan Forgiveness Program, the Senator Patricia K. McGee Nursing Faculty Scholarship and the Nursing Faculty Loan Forgiveness Incentive Program until 2016, and retroactively for the 2010-11 academic year.
• Continues State support of the NYHELPs college fee, and makes available up to $15 million for fixed rate loans for eligible students attending a participating college in 2011-12.
• Authorizes TAP awards for students who attend institutions not currently under the supervision of SED.
• Amends the New York State District Attorney and Indigent Legal Services Attorney Loan Forgiveness Program to require New York State residency and to clarify the calculation of applicable eligibility timeframes.
• Maintains the requirement that minimum academic standards for non-remedial students be increased for continued TAP eligibility, but modifies the standards to be more attainable for students first receiving state aid in 2010-11 and thereafter. Those meeting the definition of “remedial student” will not be subject to the new academic standards. “Remedial student” is defined as a student: (a) whose scores on a recognized college placement exam or nationally recognized standardized exam indicated the need for remediation for at least two semesters, as certified by the college and approved by the New York State Education Department (SED); or (b) who was enrolled in at least six semester hours of non-credit remedial courses, as approved by SED, in the first term they received a TAP award; or (c) who is or was enrolled in an opportunity program. Those meeting the definition of “remedial student” will not be subject to the new academic standards but rather will stay on the 2006 chart.
